Importance of the Artist’s Bill of Rights 

In contrast to European nations, where moral rights are more broadly recognized and protected, the United States takes a more limited approach. Moral rights, such as the right to prevent distortion or alteration of one’s work and to maintain the integrity of the artistic vision, are crucial for artists. However, these rights are not as strongly emphasized in the U.S. legal framework. This lack of recognition leaves American artists vulnerable to exploitation, misrepresentation, and loss of control over their work. The Artist’s Bill of Rights seeks to fill this gap, ensuring that artists in America receive the respect, protection, and fair treatment they deserve. By establishing these rights, we aim to create an environment where artists can thrive creatively and financially, contributing to a richer cultural landscape and a more just and equitable society. 

 

Preamble 

We, the creators of original works in the United States, recognizing the vital importance of artistic expression to our nation's cultural, economic, and social fabric, establish this Artist’s Bill of Rights. These rights are designed to ensure the fair treatment, protection, and empowerment of artists across all mediums, including authors, visual artists, musicians, architects, and other creators. This Bill of Rights aims to be adopted by states and, ultimately, at the federal level to safeguard the interests and well-being of all artists. 

 

Rights of Artists 

 

1. Right to Creative Expression 

 

    •    Artists have the right to create and perform works that reflect their artistic vision and personal style without undue interference or censorship. 

 

2. Right to Fair Compensation 

 

    •    Artists have the right to receive fair compensation for their works, including performances, recordings, publications, and merchandise sales. This encompasses fair payment for streaming, digital uses, and other emerging platforms. 

 

3. Right to Creative Control 

 

    •    Artists have the right to maintain creative control over their works, branding, and image. This includes the right to approve or reject any changes made to their work. 

 

4. Right to Safe Working Conditions 

 

    •    Artists have the right to perform and create in safe and secure environments, free from physical harm, sexual harassment, and assault. 

 

5. Right to Intellectual Property 

 

    •    Artists have the right to retain ownership and control of their intellectual property, including works, lyrics, designs, and other creations. This includes the right to receive proper credit and attribution for their work. 

 

6. Right to Privacy 

 

    •    Artists have the right to privacy and protection of their personal information and images. This includes the right to control the use of their likeness in advertising and promotional materials. 

 

7. Right to Equal Treatment 

 

    •    Artists have the right to equal treatment regardless of gender, race, ethnicity, sexual orientation, or religious beliefs. This includes equal opportunities for promotion, exposure, and professional advancement. 

 

8. Right to Respectful Treatment 

 

    •    Artists have the right to be treated with respect and dignity by their managers, promoters, and other industry professionals. This includes protection from exploitation and abuse. 

 

9. Right to Transparency 

 

    •    Artists have the right to transparency in all financial transactions related to their works. This includes clear and detailed accounting of all earnings and expenses. 

 

10. Right to Work-Life Balance 

 

    •    Artists have the right to maintain a healthy work-life balance, free from exploitation and burnout. This includes reasonable working hours and time off for rest and personal pursuits.
